SHORT-TERM  VILLA  RENTAL

 

THIS AGREEMENT made this (date) between Rolston & Jean Michael of All Saints, Antigua (hereinafter called ‘the Landlord’) and (tenant), e-mail:(e-mail address), tel: (telephone number) (hereinafter called ‘the Tenant’).

 

Whereas the Landlord is the owner of the premises Willoughby, situated at Willoughby Bay, Antigua, tel: 560 1025, consisting of a fully furnished and fully equipped dwelling house with swimming pool (hereinafter called the premises). 

 

And whereas the Landlord is desirous of letting the Tenant rent the premises for the term of the rental and in accordance with the conditions hereinafter stated.

 

Wherefore it is agreed as follows:

 

 

 

1. (a) 

The Landlord lets and the Tenant takes all those premises above described for the term of (number of nights), from (arrival date) to (departure date), at a total payable of US$/£ (amount to be paid) rent plus US$/£ (amount to be deposited) refundable security deposit.

 

The rent of US$/£ (amount to be paid) is payable in two installments:

i)  1st rent installment US$/£ (amount to be paid in 1st rent installment) payable no later than (date agreed with owners)

            

ii) 2nd rent installment US$/£ (amount to be paid in 2nd rent installment) plus US$/£ (amount of deposit to be paid) refundable security deposit, payable no later than (date), 4 weeks prior to commencement of the Tenant’s stay.

            

1(b)

i)  You may pay the security deposit and rental fee by Paypal (information will be given by owners):

 

OR

 

ii)  If paying in US$ by wire transfer, please transfer via: (information will be given by owners)

 

OR

 

iii) If you wish to pay by personal cheque, please ensure that you send your cheque by registered mail to: (information will be given by owners)

 

to arrive in Antigua three weeks in advance of each eventual payment date (e.g. payment date 24th November – cheque                 arrival date 3rd November).

 

OR

 

iv) If paying £ sterling in UK by direct bank transfer, please pay to: (information will be given by owners)

 

 

 

 

2. Cancellation

Upon cancellation following payment of the first rent instalment, the Landlord will retain the first rent instalment and offer the Tenant alternative dates during the same season ………. or the next low season (subject to availability in each case).

 

Upon cancellation following payment of the second rent installment and the refundable security deposit, the Landlord will retain both rent payments and the refundable security deposit and offer the Tenant alternative dates during the same season (name of season) or the next low season (subject to availability in each case).

 

In each case, the Tenant will be responsible for paying the difference between the value of the original booking and the value of the alternative booking.  If no agreement on dates can be reached, the Landlord will retain the rent and return the security deposit to the Tenant.

 

 

 

3. The Tenant hereby covenants with the Landlord that he will:

(i)  Pay the agreed refundable security deposit and rental on the dates hereinbefore stated.  If rental fee is more than five (5) days late, a five percent (5%) charge may be added to the rent due.

 

(ii)  Keep and maintain the premises and contents in good condition (clean, orderly and tenantable condition).

 

(iii)  Conserve and use all utilities prudently – gas (incl. cooking gas), electricity (incl. air conditioning units), water – turn them off whenever they are not in use or the Tenant leaves the building, and not be wasteful with them.

 

(iv)  Pay all charges for telephone, i.e. all charges over and above the line rental (EC$35) which is to the account of the Landlord.

 

(v)  Return the premises on the termination of the tenancy in as good a condition as the same were delivered to the Tenant at the commencement of the Tenancy.

 

(vi)  Use the premises as a dwelling for no more than (4) people during the term of this agreement, unless with the prior agreement of the Landlord.

 

(vii)  Permit the Landlord or his agent to inspect the premises at reasonable intervals of time at such times as may be agreed.

 

(viii)  Not to do or permit any act or thing which constitutes or creates a nuisance to the occupiers of dwelling houses in the surrounding areas.

 

 

 

4.  The Landlord hereby covenants with the Tenant as follows:

 

(i)  To keep in force a policy or policies of insurance on the premises and contents thereof against fire, hurricane, earthquake, flood and windstorm.

 

(ii)  To permit the Tenant to enjoy the premises during the demised term without interruption by the Landlord or any person acting on his behalf.

 

(iii)  Provided always that if the Tenant shall be, in the opinion of the Landlord, in breach of any part of the Tenant’s covenant hereinbefore stated the Landlord shall notify the Tenant.

 

(iv)  Pay the national telephone line rental and all charges for gas, water and electricity.

 

(v)  Be responsible for buildings maintenance, gardening, pool maintenance, pool chemicals, generator maintenance, Cable TV and local telephone line rental.

 

(vi)  The Security Deposit of US$240/£150 will be held and refunded to the Tenant within three weeks of the end of the tenancy upon the safe return of all keys, provided all of the Tenant’s bills are paid and the premises are returned in similar condition as the same were delivered to the Tenant at the commencement of the tenancy.
